Accident at Work
A shift supervisor employed by a building supplier in the
South Yorkshire area has secured substantial damages with the help of Beresfords Solicitors after his arm was amputated above the elbow in a workplace accident
Although liability was admitted by the company it did not agree to pay full compensation until Beresfords intervened to negotiate a more satisfactory settlement.
Health and Safety
Darren Langton of Beresfords Solicitors, said: “I am pleased to have been able to help and advise our client to ensure received a proper award of compensation. A case such as this demonstrates that at all relevant times the Provision and Use of Work Equipment Regulations 1998 and the Management of Health and Safety at Work Regulations 1999 apply to the employees work. Action of this nature pressurises employers into providing safe working environments. It makes them think twice about taking shortcuts which appear to save money in the short term, but which put their employees and others at risk. This was a serious injury and the company was convicted at the Worksop Magistrates Court on the 11th December 2003 of an offence pursuant to the Provision and Use of Work Equipment Regulations 1998. The conviction was used as evidence of the Defendant’s negligence.
The client said: “I am happy that as a result of all the help, care, assistance and advice I have been able to return to work albeit in a different capacity and secure substantial damages”.
