Sheffield Steel Workers receive payout
Beresfords Solicitors managed a group action on behalf of 14 Fettlers and Welders at Noel Village (Steel Foundry) Limited in Doncaster which resulted in a total payout of £250,000 in compensation. Individual awards varied between £5,000 and £40,000 depending on the age and severity of symptoms experienced by the individuals in question.
Proceedings were issued in these cases and settlement was brokered within only 5 months, demonstrating the pro-active attitude to litigation favoured by Beresfords.
More recently though, Senior Solicitor and Associate, David Eade (pictured above) steered home claims for a team of workers at Sheffield steel firm, Thornton Precision Components. These cases were fiercely defended, but were settled on the morning of the trial.
The claims involved Carpal Tunnel Syndrome and Vibration White Finger, and were made all the more difficult by the Defendant's negative medical reports in each of the cases. On top of all this, complicated employment issues arose when some of the Claimants were made redundant, and others had their overtime withdrawn. Admissions of liability had been made in some cases before proceedings were commenced, but were withdrawn, demonstrating that the risks of litigation are often far from clear.
The successful outcome provided compensation payments of £12,000, £40,000, £50,000 and £65,000, and it looks like there’s more to come!
In another Sheffield steel firm case Beresfords Solicitors recorded an £80,000 settlement for a 36 year old Fettler. This stage 3 Vibration White Finger sufferer was taken off his job and moved to a position as a Furnaceman, which was less well paid, as a direct consequence of his condition.
This claim has been made all the more important by virtue of the fact that the Claimant is one of 14 other employees at that particular firm pursuing similar claims. So far 4 others have been to trial and settled and we hope to have more news soon!
